Wildfolio – Terms of Service

1. Purpose of the Services

Wildfolio provides market intelligence, portfolio tracking, and analytical tools related to exotic livestock, wildlife, and specialty agricultural markets. The Services are designed to support decision-making by providing historical, aggregated, and analytical information, including data, models, and analytical indicators derived from market activity.

Wildfolio does not:

• Act as a broker, dealer, auctioneer, marketplace, or appraiser
• Facilitate transactions, negotiations, or payments
• Provide certified valuations or appraisals
• Provide financial, investment, legal, or tax advice

Nothing within the Services should be interpreted as advice, a recommendation, or a solicitation to buy, sell, or hold any asset.

2. Eligibility

You must be at least 18 years of age to use the Services. By using Wildfolio, you represent and warrant that:

• You are legally capable of entering into binding agreements
• You are using the Services for lawful purposes only
• Any information you provide is accurate, current, and complete

3. Accounts and Access

Certain features of the Services require registration of an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

You agree to notify us immediately at support@wildfol.io of any unauthorized access or use of your account.

Wildfolio reserves the right to suspend or terminate accounts that violate these Terms or pose a risk to the Services, other users, or system integrity.

4. Data Sources, Models, and Accuracy

The Services aggregate, process, and analyze data from multiple sources, including third-party listings, public records, historical transactions, automated enrichment systems, and user-provided information.

You acknowledge and agree that:

• Market data may be incomplete, delayed, revised, or inaccurate
• Wildfolio does not independently verify third-party data
• Models rely on historical and rolling time windows that evolve over time
• Outputs are probabilistic, interpretive, and analytical—not deterministic
• Automated classifications, forecasts, or insights may be incomplete, incorrect, or unsuitable for any particular use case.

Wildfolio makes no guarantees regarding the accuracy, completeness, timeliness, or reliability of any data, outputs, or insights provided through the Services.

5. No Reliance; Assumption of Risk

You acknowledge and agree that:

• Livestock and wildlife markets are inherently volatile, illiquid, and subject to regulatory constraints
• Decisions based on the Services are made at your sole discretion and risk
• Wildfolio is not responsible for financial losses, missed opportunities, operational outcomes, or regulatory consequences

You are solely responsible for:

• Independently verifying information
• Consulting appropriate professionals where necessary
• Complying with all applicable laws, regulations, permits, and reporting requirements related to the ownership, transfer, sale, transport, or valuation of animals or related assets

6. Subscription Plans and Payments

Certain features of the Services require a paid subscription.

By subscribing, you agree to:

• Pay all applicable fees associated with your selected plan
• Authorize recurring billing where applicable

Unless otherwise stated:

• Fees are non-refundable
• Subscriptions renew automatically until canceled

Wildfolio reserves the right to modify pricing, plans, or features with reasonable advance notice.

7. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, or abusive purposes
• Reverse engineer, scrape, extract, or attempt to access proprietary models, taxonomies, or datasets
• Interfere with system security, availability, or integrity
• Misrepresent outputs as certified valuations, guarantees, or authoritative appraisals
• Resell, sublicense, publish, or commercially redistribute outputs, reports, or insights without prior written authorization

Wildfolio may investigate violations and take appropriate action, including suspension or termination of access.

8. Intellectual Property

All content, software, analytics, models, designs, methodologies, taxonomies, scoring systems, enrichment logic, user interfaces, trademarks, and documentation within the Services (excluding User Content) are owned by or licensed to Wildfolio and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your internal purposes.

You may not copy, modify, distribute, or create derivative works without prior written consent.

9. User Content, Confidentiality, and Data Use

User-provided data is handled in accordance with the Wildfolio Privacy Policy.

By submitting content, you grant Wildfolio a non-exclusive, worldwide, royalty-free license to use, process, store, and display such content solely to operate and improve the Services.

Wildfolio may:

• Aggregate and anonymize data for research and model improvement
• Use non-identifiable insights for system development

Wildfolio does not sell identifiable user data.

10. Service Availability

The Services are provided on an "as-is" and "as-available" basis.

Wildfolio does not guarantee:

• Continuous or uninterrupted availability
• Error-free operation
• Compatibility with all devices or environments

Scheduled maintenance, updates, or outages may occur without notice.

11. Termination

You may cancel your account at any time.

Wildfolio may suspend or terminate access:

• For violations of these Terms
• To comply with legal obligations
• To protect the Services or other users

Upon termination, your right to use the Services ceases immediately. Wildfolio may retain certain data as required for legal, regulatory, or operational purposes, in accordance with the Privacy Policy.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided without warranties of any kind, express or implied, including warranties of:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

Use of the Services is at your sole risk.

13. Limitation of Liability

To the maximum extent permitted by law:

• Wildfolio shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunities.
• Wildfolio's total liability for any claim shall not exceed the amount paid by you to Wildfolio in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Wildfolio, its officers, directors, employees, contractors, and partners from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your misuse or misrepresentation of data or outputs

15. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the state or federal courts located within the State of Texas.

16. Changes to These Terms

Wildfolio may update these Terms from time to time.

Material changes will be communicated via the Services or email. Continued use of the Services after changes constitutes acceptance of the revised Terms.
